Collections

Collection matters are generally handled on a contingent fee basis. If an indebtedness is based on a contract which contains an attorney's fee provision, suit is filed for past-due principal, prejudgment interest at the contract rate, and a one-third attorney's fee, unless the contract provides for a lesser percentage.

Most judges in Tennessee award one-third of the past due principal and interest as a reasonable attorney’s fee and include that amount in the judgment.

Possessory Actions

Pre-judgment possessory actions are handled throughout the state of Tennessee on a flat fee basis, plus court costs.

Foreclosures

Services provided for foreclosure representation include performing a title search, conducting the foreclosure sale, and preparing and recording a trustee's deed.

Representation is generally on a flat fee basis, plus costs of publication and recording fees.

Neither the firm nor any of its members are certified as Civil Trial, Consumer Bankruptcy, Business Bankruptcy, or Creditors Rights Specialists by the Tennessee Commission on Continuing Legal Education and Specialization.
