Collection
matters are generally handled on a contingent fee
basis. If an indebtedness is based on a contract
which contains an attorney's fee provision, suit is
filed for past-due principal, prejudgment interest at
the contract rate, and a one-third attorney's fee,
unless the contract provides for a lesser percentage.
Most
judges in Tennessee award one-third of the past due
principal and interest as a reasonable
attorneys fee and include that amount in the
judgment.
Possessory Actions
Pre-judgment
possessory actions are handled throughout the state
of Tennessee on a flat fee basis, plus court costs.
Foreclosures
Services
provided for foreclosure representation include
performing a title search, conducting the foreclosure
sale, and preparing and recording a trustee's deed.
Representation
is generally on a flat fee basis, plus costs of
publication and recording fees.
Neither the firm
