Grisham, Knight & Hooper regularly provides representation on bankruptcy matters in the United States Bankruptcy Court, Eastern District, Southern Division (Chattanooga, Tennessee) and in the United States Bankruptcy Court, Eastern District, Winchester Division (Winchester, Tennessee).

Chapter 13 Cases

Chapter 13 representation is generally provided on a flat fee basis. Services include preparing and filing a proof of claim, appearing at the meeting of creditors, verifying insurance coverage, insuring that the plan includes a reasonable rate of interest and that a reasonable value for the collateral, and, if necessary, filing an objection to confirmation and appearing at the objection hearing.

If the claim is based on a contract which contains an attorney's fee provision, the firm’s fee will be added to and allowed as part of the claim.

Additional fees are charged for post-confirmation representation on matters such as motions to lift stay, motions to dismiss, motions to require insurance, and the like.

Chapter 7 Cases

Chapter 7 representation is also provided on a flat fee basis. The firm prepares and files a proof of claim (which is required for all secured claims in Tennessee), attends the meeting of creditors, and secures signatures on either a reaffirmation agreement or an agreed order lifting the automatic stay.

Chapter 11 and 12 Cases

Representation in Chapter 11 and 12 cases is on a flat fee basis for the same types of basic services provided in Chapter 7 and 13 cases.  However, if services other than preparing and filing a proof of claim and attending the meeting of creditors is required, such representation is on an hourly basis.

Other Bankruptcy Matters

Other bankruptcy representation is provided for defense of preference actions, defense of lien avoidance actions, complaints objecting to discharge, and the like.

Generally, such representation is provided on an hourly basis.

Neither the firm nor any of its members are certified as Civil Trial, Consumer Bankruptcy, Business Bankruptcy, or Creditors Rights Specialists by the Tennessee Commission on Continuing Legal Education and Specialization.
